GENERAL TERMS OF USE OF THE SITE AND SERVICES OFFERED:

Use of the site implies full acceptance of the general terms of use described below. The general terms of use of the site are subject to modification or completion at any time, users of the site are therefore invited to consult them regularly. This site is normally accessible to users at all times. However, an interruption for technical maintenance reasons may be decided by L’Enfant Roi, who will then endeavor to communicate to users in advance the dates and times of the intervention. The site is regularly updated by Groupe L’Enfant Roi SàrL. In the same way, the legal notices can be modified at any time: they are nevertheless binding on the user who is invited to refer to them as often as possible in order to take note of them.

 

DESCRIPTION OF THE SERVICES PROVIDED:

The purpose of the site is to provide information concerning all the activities of the company. L’Enfant Roi strives to provide the most accurate information possible on the site. However, it cannot be held responsible for omissions, inaccuracies and deficiencies in the update, whether by its own fault or by the fault of third-party partners who provide it with this information. All the information indicated on the site are given for information only and may evolve. Furthermore, the information on the site is not exhaustive. They are provided subject to modifications having been made since they were put online.

 

CONTRACTUAL LIMITATIONS ON TECHNICAL DATA:

The site uses JavaScript technology. The site cannot be held responsible for material damage linked to its use. In addition, the user of the site undertakes to access the site using recent material, not containing viruses and with a latest generation browser updated.

 

INTELLECTUAL PROPERTY AND COUNTERFEITING:

In accordance with the provisions on copyright and intellectual property, L’Enfant Roi is the owner of intellectual property rights or holds the rights of use on all elements accessible on the site, in particular texts, images, graphics, logo, comments, databases, icons, sounds, software for the legal duration of protection and for the whole world. The aforementioned elements are protected by copyright, and, in general, by the principles of intellectual property. Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is prohibited, except with the prior written authorization of L’Enfant Roi. Any unauthorized exploitation of the site or any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of the amended law of April 18, 2001 on copyright, related rights and databases.

 

LIMITATIONS OF LIABILITY:

L’Enfant Roi shall not be held liable for any direct or indirect damage suffered by the user/visitor of the site. In particular, L’Enfant Roi shall not be held liable for direct and indirect damage caused to the user’s equipment, when accessing the site, and resulting either from the use of equipment that does not meet the specifications indicated in the paragraph “CONTRACTUAL LIMITATIONS ON TECHNICAL DATA”, or from the appearance of a bug or an incompatibility. L’Enfant Roi shall also not be held liable for indirect damage (such as for example a loss of market or loss of an opportunity) resulting from the use of the site. The list is not exhaustive.

Interactive spaces (possibility to ask questions in the contact space) are available to users. L’Enfant Roi reserves the right to delete, without prior notice, any content posted in this space that would contravene the legislation applicable in Luxembourg, in particular the provisions relating to data protection. If necessary, L’Enfant Roi also reserves the right to engage the civil and/or criminal liability of the user, in particular in the event of a message of a racist, insulting, defamatory, or pornographic nature, whatever the medium used (text, photograph, etc.).

 

PERSONAL DATA MANAGEMENT:

Nature of personal data collected

When consulting the l’enfant-roi.lu site, the following data are collected on the server and temporarily stored: user’s IP protocol address, date and time of connection, URL of the links through which the user accessed the site, browser, access provider and operating system of the client’s computer. L’Enfant Roi may also be required to collect personal data from users/visitors of the site in the context of the use of the interactive spaces made available to them.

Use of personal data collected

The user of the site authorizes L’Enfant Roi to process the personal data that are communicated to him in the context of the consultation of the site and for the needs of certain services offered by the site. The user provides this information in full knowledge of the facts, particularly when he enters it himself. The user of the site is then informed of the obligation or not to provide this information.

Groupe L’Enfant Roi SàrL processes the personal data communicated to it by the user/visitor of the site in strict compliance with the regulations in force and in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

In accordance with Article 5 1. e) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data, the personal data collected by L’Enfant Roi SàrL are stored in a form allowing the identification of the data subjects for a period not exceeding that necessary for the purposes for which they are processed.

 

No personal information of the site user is published without the user’s knowledge, exchanged, transferred, assigned or sold on any medium whatsoever to third parties. Only the hypothesis of the buyout of L’Enfant Roi and its rights would allow the transmission of said information to the possible acquirer who would in turn be bound by the same obligation of conservation and modification of the data vis-à-vis the site user.

 

APPLICABLE LAW AND JURISDICTION :

Any dispute in connection with these legal notices, their execution and interpretation, with the use of the site, as well as the acts that would result therefrom, is subject to Luxembourg law.

Exclusive jurisdiction is granted to the competent courts of Luxembourg.
